Essential Guide to Florida Boat Rentals: Legal Requirements and Safety Tips

Planning to rent a boat or a unique floating accommodation in Florida? Whether you’re looking to enjoy the serene waters of Key Largo or explore other parts of Florida, understanding the state’s boating laws is crucial. This guide provides all the information you need to ensure your boating experience is both enjoyable and compliant with Florida regulations.

Understanding Florida’s Boating Safety Card Requirements

Before you set sail or settle into a floating bungalow, it’s important to know whether you need a boating safety card under Florida State Code 327.395. Here’s what you need to prepare:

  • Who Needs a Boating Safety Card?
Guests born on or after January 1, 1988, must have a valid safety card to operate a boat or rent a floating bungalow in Florida, or to be accompanied by someone who was either born before 1987 or who already holds the above card, which has no expiry date.
  • Certification for Out-of-State Visitors
Visitors from other states can use proof of completion of an approved boating safety education course that meets NASBLA standards. Visitors from Canada may use a Canadian Pleasure Craft Operator Card. Additionally, a valid International Certificate of Competency is also accepted.
  • Quick Certification
Obtain a temporary boating safety certificate by completing a short online test—ideal for tourists and short-term visitors. This certificate is available for a small fee and is valid for 90 days.
  • Study and Test Link
Prepare using our Boater’s Safety Study Guide and take your test at the Florida Boating Safety Test site. It does cost $10 to take the test. The website also has a study guide and is designed to make it easy for you to pass the test. On the website, just click “Get Started” to create an account and prepare to take the exam.
  • Once Completed                                                                                                                                                                                                        If you are planning an upcoming stay with Ombi, please send your completed boating safety test results and a copy of your boating license to [email protected]

Livery Usage Agreement

Most vessels available for rent, whether a jet ski or a boat for the weekend, are identified as a livery under Florida law. To operate a livery, you are required to fill out a Livery Usage Agreement along with the person renting you the vessel.

Our bungalows, though beautifully designed to provide the comfort and appearance of a modern resort, are legally considered vessels under Florida law. Renting one of our floating bungalows is viewed by the state as renting a boat. Do not worry, though, these forms will be explained to you and filled out with your captain on the day of your arrival, so please do not worry about filling them out now.

  • Important Clarification: You will be renting the bungalow as a boat, but you will not be permitted to operate or move the vessel in any way.
  • Why This Matters: The state requires a rental agreement signed by both parties to ensure that everyone understands these distinctions and the specific legalities associated with this type of rental. Compliance with this regulation is paramount, and you will be unable to continue with your reservation without agreeing to these state forms.
  • Completing the Agreement: You will fill these two documents out with your captain on the day of your arrival. They are attached here so you can peruse and see what you are agreeing to by booking a bungalow with Ombi. The two Livery Usage Agreement forms are provided below:

Again, you will fill these two forms out the day of your reservation with your captain. Do not worry about filling them out now.

Conclusion

Renting a boat or floating bungalow in Florida is an excellent way to explore the state’s beautiful waterways, but it comes with responsibilities.
